The Polish version is the original; this English text is a translation.
1. General
- These terms set out the rules for using the ProxyTalk service available at
proxy.talk(the "Service"). - The service provider is Paweł Przytuła, running a sole proprietorship under the name "Paweł Przytuła", ul. Heweliusza 11/811, 80-890 Gdańsk, Poland, tax ID (NIP) 5862217680 (the "Provider"). Contact: kontakt@proxy.talk.
- How personal data is processed is described in the Privacy Policy.
2. What the Service is
ProxyTalk lets you create an AI agent that talks on your behalf to people who visit your chat page or scan a QR code. The agent answers based on the knowledge, goal and behavior you configure and the files you upload. Replies are generated by external artificial intelligence models.
3. Definitions
- User: an adult who has created an account in the Service.
- Agent: an AI agent configured by the User.
- Chat visitor: a person talking to an Agent. A chat visitor does not create an account.
- User Content: everything the User enters into the Service, including the Agent's name and description, knowledge, goal, behavior, greeting, files and images.
4. Account
- Only adults may create an account. Sign-in is by email address or Google account.
- The User provides accurate information and is responsible for keeping access to their account secure.
- The User may delete their account at any time in account settings. Deletion is irreversible and covers all Agents, their files, conversations, QR codes and uploaded images.
5. Rules of use
The User agrees that:
- User Content is lawful and does not infringe the rights of third parties, including copyright and personal rights.
- They will not put third parties' personal data or special-category data (for example health data) into the Service without a legal basis to do so.
- They will not use an Agent to mislead people, including impersonating another person or organization, or for unlawful activity such as fraud, spam, harassment or distributing illegal content.
- They will not try to bypass the Service's safeguards, overload its infrastructure or access other people's data.
- They will inform chat visitors, to the extent required by law, that they are talking to an AI agent. The chat page includes such a notice, but the User is responsible for how they present the Agent.
The Provider may block an Agent or account that violates these terms or the law.
6. Limits of artificial intelligence
- The Agent's replies are generated automatically and may be incomplete, out of date or wrong.
- The Agent's replies are not legal, medical, financial or other professional advice.
- The User is responsible for how they use the Agent and its replies, and for checking that the Agent's configuration is correct.
- Conversation content and the Agent's configuration are sent to external AI model providers. In the free version of the Service, providers may use this data to train models. The Privacy Policy gives details.
7. User Content and rights
- The User keeps all rights to User Content.
- The User grants the Provider a non-exclusive, royalty-free licence to store, process and display User Content to the extent necessary to provide the Service, including passing it to AI model and infrastructure providers.
- The User confirms that they have the right to upload files and other content to the Service.
- Rights to the software, name and marks of ProxyTalk belong to the Provider.
8. Availability
- The Service is provided "as is". The Provider makes an effort to keep it running without interruption but does not guarantee constant availability or error-free operation.
- The Provider may change the Service, including the AI models used, limits and features, and may interrupt it for technical work.
9. Liability
- The Provider is liable for damage caused to the User under the rules set by law. To the extent permitted by law, the Provider is not liable for the content of replies generated by AI models, for User Content, or for damage resulting from the actions of third parties on which the Service depends.
- The User is responsible for User Content and for how they use the Agent towards chat visitors.
- Nothing in this section excludes or limits rights that consumers have under mandatory law.
10. Complaints
Complaints about the Service can be sent to kontakt@proxy.talk. The Provider will handle a complaint within 14 days of receiving it and reply to the email address it came from.
11. Ending use of the Service
- The User may stop using the Service at any time by deleting their account.
- The Provider may terminate the agreement or block an account in the case of a serious violation of these terms, informing the User where circumstances allow.
- After an account is deleted, printed QR codes and chat links of its Agents stop working.
12. Changes to the terms
The Provider may change these terms for important reasons, such as a change in law or in the Service's features. The Provider will notify Users of material changes by email at least 14 days before they take effect. A User who does not agree to the changes may delete their account before they take effect.
13. Final provisions
- Polish law governs agreements for use of the Service. For consumers, this does not deprive them of the protection of mandatory provisions of the law of their country of residence.
- Disputes are decided by the courts competent under the law. A consumer may use out-of-court dispute resolution, including the ODR platform at https://ec.europa.eu/consumers/odr.
